These Customer Terms & Conditions explain the basis on which QuickFix Repairs Ltd, trading as QuickFix-Repairs (“QuickFix”, “we”, “us” or “our”), provides its booking and engineer-arrangement service.

By making a booking and paying the applicable booking fee, you agree to these Terms & Conditions.

1. Our Service

QuickFix provides a booking and engineer-arrangement service for customers requiring plumbing, gas and heating, electrical and drainage repairs and maintenance.

QuickFix arranges for an independent engineer to attend the customer's property.

QuickFix is not the engineer carrying out the repair and does not employ the attending engineer unless expressly stated otherwise.

Our service is to receive your request, arrange an appropriate independent engineer, communicate booking information and assist with managing the attendance.

2. Booking Fee

A booking fee is payable directly to QuickFix for arranging and managing your booking.

The amount of the booking fee will be clearly communicated to you before payment is taken.

The booking fee is separate from the engineer's charges for labour, parts, materials and additional work.

Payment of the booking fee authorises QuickFix to begin providing its booking and arrangement service immediately.

The booking fee relates to QuickFix's service and does not itself constitute payment for repair work carried out at the property.

3. Engineer Charges

Before your booking is confirmed, QuickFix will tell you the agreed charge for the engineer's first hour of labour.

By proceeding with the booking, you agree to that first-hour charge.

The first-hour labour charge is paid directly to the attending independent engineer unless expressly stated otherwise.

Where additional work, labour, parts or materials are required, the engineer should explain the additional charges before proceeding with that additional work.

QuickFix does not receive payment for the engineer's labour, parts or materials unless expressly stated otherwise.

4. Attendance Options & Timeframes

Depending on availability, QuickFix may offer different attendance options, including emergency, same-day and next-day attendance.

Where an estimated attendance timeframe is selected, QuickFix will arrange the booking on that basis and communicate the agreed timeframe to the engineer.

Attendance times are estimates and may be affected by circumstances outside QuickFix's reasonable control, including traffic, previous emergency jobs, access problems, weather, breakdowns or unforeseen delays.

Customers must ensure that somebody is available at the property during the agreed attendance period.

QuickFix will make reasonable efforts to keep customers informed of significant changes to the expected attendance time.

A delay does not automatically entitle the customer to a full refund of the booking fee. Where there has been a significant delay attributable to the arranged service, QuickFix will consider the circumstances and any refund or price reduction to which the customer may be legally entitled.

5. Engineer Details

Once an engineer has been assigned and attendance confirmed, QuickFix will provide available details of the attending engineer and/or business together with expected arrival information.

The engineer is responsible for inspecting and diagnosing the issue and determining what work can safely and appropriately be undertaken.

An engineer may refuse or stop work where they reasonably consider the work, property, appliance, installation or surrounding conditions unsafe or unlawful.

Such refusal does not automatically mean QuickFix's booking and arrangement service has not been provided.

6. Independent Engineers

Engineers arranged through QuickFix operate independently and are responsible for the repair services they provide.

The contract for the engineer's labour, parts, materials and additional repair work is between the customer and the attending engineer.

The engineer is responsible for the quality, safety and completion of their work and for warranties or guarantees they provide in relation to that work.

Nothing in these Terms excludes or limits liability which cannot lawfully be excluded or limited.

7. Cancellations & Refunds

QuickFix begins providing its booking and arrangement service once the customer instructs us to proceed and payment of the booking fee has been received.

Cancellation before an engineer is assigned

If the customer cancels after QuickFix has begun providing its booking and arrangement service but before an engineer has been assigned or the attendance confirmed, QuickFix may retain an amount reasonably reflecting the booking, administration and arrangement work already undertaken and any direct loss resulting from the cancellation.

Any remaining balance of the booking fee will be refunded.

This does not affect any greater refund to which the customer is legally entitled.

Cancellation after engineer assignment or confirmation

Once an engineer has been assigned and/or attendance confirmed, a substantial part, and in some circumstances all, of QuickFix's booking and arrangement service may already have been performed.

If the customer then cancels, QuickFix may retain the proportion of the booking fee reasonably attributable to the service already supplied and any direct loss resulting from the cancellation.

Where the booking and arrangement service has been fully performed, the booking fee may therefore be retained in full, subject always to the customer's statutory rights.

Engineer delays

If an attending engineer is delayed beyond an estimated or agreed attendance timeframe, this does not automatically entitle the customer to a full refund.

Where there has been a significant delay attributable to the arranged attendance, QuickFix will assess the circumstances and may provide an appropriate partial refund or other remedy. Nothing in this provision restricts any remedy required by law.

QuickFix unable to arrange attendance

If QuickFix is unable to provide the booking and arrangement service purchased, QuickFix will provide any refund or other remedy required under these Terms and applicable consumer law.

Nothing in this section affects the customer's statutory rights.

8. Urgent Repairs & Cancellation Rights

Where the customer is a consumer and the booking is made at a distance, the customer may have a statutory right to cancel the QuickFix booking and arrangement service within 14 days, subject to the applicable exceptions and conditions under consumer law.

Where the customer asks QuickFix to begin providing its booking and arrangement service during the 14-day cancellation period, the customer expressly requests that performance of the service begins immediately.

If the customer subsequently exercises a statutory right to cancel after performance has begun, the customer may be required to pay an amount proportionate to the booking and arrangement service supplied up to the time QuickFix is informed of the cancellation, where permitted by law.

Where the QuickFix booking and arrangement service has been fully performed during the cancellation period following the customer's express request, the statutory right to cancel that service may be lost where the legal requirements for loss of that right have been satisfied.

Nothing in these Terms limits or excludes any cancellation, refund or other statutory rights available to the customer under applicable law.

9. Information Provided by the Customer

The customer is responsible for providing accurate information about the problem, property and circumstances of the call-out.

QuickFix relies upon this information when identifying and arranging an appropriate engineer.

Descriptions given over the telephone, online, by text or otherwise are used to arrange an engineer and do not constitute a diagnosis by QuickFix.

The actual cause of a fault may differ from the customer's description.

If materially incorrect or incomplete information results in the wrong type of engineer being arranged, prevents attendance or materially changes the nature of the required work, this may affect the service that can be provided and any refund due.

The customer must disclose information that may materially affect the engineer's ability to attend or safely carry out work.

10. Property Access & Failed Attendance

The customer must provide reasonable access to the property at the agreed attendance time.

If the engineer cannot gain access, nobody is available at the property, the customer refuses attendance, or inaccurate information supplied by the customer prevents the attendance from proceeding, QuickFix may treat its booking and arrangement service as having been provided to the extent it has already been performed.

Any refund will depend upon the circumstances, the service already supplied and the customer's statutory rights.

Any engineer charges resulting from a failed attendance are a matter between the customer and engineer.

11. Parts, Materials & Additional Work

The initial engineer charge agreed when booking relates to the first hour of labour unless expressly stated otherwise.

Parts and materials are not included unless specifically agreed.

Additional work beyond the agreed first hour should be discussed with the customer by the engineer before proceeding.

The customer is responsible for deciding whether to authorise additional work.

QuickFix does not guarantee the availability of any particular replacement part or material.

Where parts must be ordered, a repair may require a return visit.

Any price, payment or arrangements for additional engineer work are between the customer and engineer unless QuickFix expressly states otherwise.

12. Diagnosis & Completion

Arranging attendance does not guarantee that a fault can be repaired during the first visit or first hour.

Some faults require further investigation, specialist equipment, parts, additional labour or a return visit.

The engineer will determine the appropriate diagnosis and repair based upon the conditions found at the property.

QuickFix does not guarantee that every repair can be completed during the initial attendance.

The agreed first-hour engineer charge remains applicable to the engineer's attendance and labour even where a complete repair cannot be achieved within that hour, subject to the customer's legal rights and the terms agreed with the engineer.

13. Replacement Engineers

Occasionally an assigned engineer may become unavailable because of illness, breakdown, an earlier emergency, safety concerns or another circumstance outside QuickFix's reasonable control.

Where this happens, QuickFix may attempt to arrange an alternative suitable engineer.

QuickFix will communicate material changes to the customer as soon as reasonably practicable.

If QuickFix cannot provide the booking and arrangement service purchased, any appropriate refund or remedy will be assessed in accordance with these Terms and applicable law.

14. Parking, Access and Additional Attendance Costs

The customer should tell QuickFix about any unusual access restrictions, parking restrictions, permits, congestion charges or other circumstances that may materially affect attendance.

Any parking, permit, congestion or similar attendance cost charged by an engineer should be disclosed where reasonably practicable and is payable to the engineer rather than QuickFix unless expressly stated otherwise.

15. Engineer Warranties & Return Visits

Any warranty or guarantee relating to repair workmanship, parts or materials supplied by an independent engineer is provided by that engineer unless QuickFix expressly confirms otherwise in writing.

If a customer believes repair work is defective, the issue should initially be raised with the engineer who performed the work.

QuickFix may assist communication between the customer and engineer but does not automatically assume responsibility for the engineer's warranty obligations.

16. Complaints

If your complaint concerns QuickFix's booking or arrangement service, please contact QuickFix and we will investigate the matter.

If your complaint concerns workmanship, parts, materials, additional charges or work carried out by an independent engineer, the matter should initially be raised with the engineer responsible.

QuickFix may, where appropriate, assist communication between the customer and engineer in an effort to resolve the issue.

17. Liability

QuickFix will provide its booking and arrangement service with reasonable care and skill.

QuickFix is not responsible for losses caused solely by circumstances outside our reasonable control.

As independent engineers are responsible for the repair services they perform, QuickFix is not responsible for the engineer's workmanship, diagnosis, parts, materials or additional work except to the extent that liability legally rests with QuickFix.

Nothing in these Terms excludes or restricts liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Nothing in these Terms affects your statutory consumer rights.

18. Circumstances Outside Reasonable Control

QuickFix will not be responsible for delay or failure caused solely by events outside its reasonable control.

These may include severe weather, road closures, traffic disruption, vehicle breakdown, utility or telecommunications failures, emergency incidents, illness, engineer unavailability or other unforeseen circumstances.

Where such an event affects a booking, QuickFix will make reasonable efforts to inform the customer and, where appropriate, arrange an alternative engineer or attendance.

This provision does not remove any rights or remedies the customer has under applicable law.

19. Payment

The QuickFix booking fee is payable using the payment method agreed when the booking is made.

Engineer labour charges, parts, materials and additional work are payable directly to the attending engineer unless expressly stated otherwise.

Customers should obtain appropriate receipts or invoices directly from the engineer for payments made to them.

20. Chargebacks & Payment Disputes

If you believe a QuickFix booking-fee payment has been taken incorrectly or you dispute the service provided, please contact QuickFix so that the matter can be investigated.

Initiating a chargeback does not itself determine whether a payment was contractually due or whether QuickFix provided the service purchased.

QuickFix may provide the payment provider with relevant booking records, communications, confirmation records and evidence of services performed when responding to a payment dispute.

Nothing in this section limits the customer's statutory rights or any rights available through their payment provider.

21. Personal Information

Personal information supplied to QuickFix will be used for administering enquiries and bookings, arranging engineer attendance, communicating with customers and providing our services.

Information may be shared with an independent engineer where necessary to arrange and perform the requested attendance.

22. Commercial Customers

Where a booking is made wholly or mainly for business purposes, the customer may not have the same statutory rights as a consumer.

Unless otherwise agreed, these Terms will still apply to the booking and arrangement service to the extent appropriate.

Nothing in this section removes rights which cannot lawfully be excluded.

23. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Customers retain any rights they have under applicable consumer law, including any applicable rights concerning where proceedings may be brought.
